Acceptance
By creating an account, using OTP login, browsing spas, booking services, buying packages, making payments, scanning QR codes, rating services, contacting support, or otherwise using BookMySpa, you agree to these Terms, the Privacy Policy, and the Cancellation and Refund Policy.
Eligibility And Account Security
You must be at least 18 years old and legally capable of entering a binding contract. You must provide accurate name, phone number, optional email, and booking information. You are responsible for keeping your device, phone number, OTP, and account access secure. BookMySpa may refuse, suspend, restrict, or terminate access for misuse, fraud, abuse, safety risk, legal violation, false information, payment risk, or breach of these Terms.
BookMySpa Role
BookMySpa is a technology platform and marketplace facilitator for physical spa services. It provides discovery, booking, payment, package, notification, QR check-in, review, and support tools. The actual spa service is delivered by the relevant spa, therapist, staff member, or service provider. BookMySpa does not provide medical treatment, does not employ partner therapists unless expressly stated in writing, and does not guarantee the quality, suitability, availability, safety, licensing, or conduct of third-party spas or therapists beyond platform controls.
No Medical Advice
BookMySpa is for wellness and appointment management only. Content in the app, spa descriptions, service descriptions, package names, or therapist profiles is not medical advice, diagnosis, or treatment. Do not use spa services as a substitute for professional medical care. You should not book or receive a service if you have a medical condition, pregnancy-related concern, allergy, injury, infection, or other risk without consulting a qualified professional and informing the spa where appropriate.
Bookings And Check-In
- Bookings depend on spa operating hours, service options, room availability, therapist availability, package eligibility, payment confirmation, and platform checks.
- Prices, durations, add-ons, packages, reschedule windows, refund rules, and availability may vary by spa and may change before confirmation.
- Mobile self-bookings and manager-created package bookings require QR check-in where the app says QR is required. Therapist QR generation and client scan are part of the final check-in process.
- BookMySpa may cancel, block, or modify a booking when required for payment failure, inventory conflict, fraud prevention, safety, legal compliance, or operational error.
Payments, Packages, And Cash
Online payments are processed through Razorpay or another approved processor. Cash payments are collected at the spa only where the app or manager flow permits. Package purchases are prepaid service credits with purchase-time rules, validity, eligible spas/services, and redemption limits. Unsupported service durations, insufficient service-credit balance, expired packages, or ineligible spas/services cannot be redeemed and may require choosing another package or booking without a package.
The checkout payment disclosure helps you review the payable amount, seller/payment context, package coverage, taxes/fees where shown, reschedule cutoff, and eligible non-cancellation refund route before payment. It is not a statutory tax invoice. GST invoices, TCS/TDS handling, and other tax documents are issued or exported only through the applicable tax workflow where legally required.
After a checked-in booking, the app may allow a voluntary client tip for one or more assigned therapists. Tips are never preselected, are not required for service, and must be paid only through the in-app flow. Client tips are treated as pass-through therapist earning records and do not create booking revenue, package service-credit movements, or platform commission. Tip refunds are full-refund-only support/admin actions and may hold or void unpaid tip earning lines while provider refund finality is pending.
Cancellations, Reschedules, Refunds, And No-Show
Cancellation, reschedule, and refund handling is governed by the in-app booking state and the Cancellation and Refund Policy. Client booking cancellations do not receive refunds; the self-service option is one eligible reschedule before the configured spa cutoff. No-show may be marked after the booking start time. Non-cancellation refund timing depends on Razorpay, banks, UPI, wallets, manual support review, and settlement state.
Ratings, Reviews, And User Content
You may submit ratings and review comments only for real experiences. You must not submit unlawful, defamatory, abusive, obscene, misleading, fake, infringing, discriminatory, private, or spam content. BookMySpa may moderate, hide, remove, or restrict reviews and content to protect users, comply with law, prevent fraud, or preserve platform integrity.
Prohibited Use
You must not misuse OTPs, impersonate others, create false bookings, abuse refunds, harass staff or therapists, interfere with QR check-in, reverse engineer the platform, upload malware, scrape data, violate intellectual property rights, submit false claims, or use BookMySpa for unlawful, unsafe, obscene, exploitative, or fraudulent purposes.
Third-Party Services
BookMySpa uses third-party services including payment processors, OTP providers, cloud providers, notification providers, app stores, and partner spas. Their own terms, privacy notices, and operational limits may apply. BookMySpa is not responsible for third-party outages or delays outside its reasonable control.
Intellectual Property
BookMySpa, BMS - Therapist, logos, software, workflows, text, designs, and platform content are owned by or licensed to the platform operator. You receive only a limited, revocable, non-transferable right to use the app for lawful personal booking purposes. You may not copy, modify, distribute, sell, or misuse platform materials.
Liability And Indemnity
To the maximum extent permitted by law, BookMySpa is not liable for indirect, incidental, special, punitive, consequential, or loss-of-profit damages, or for third-party spa service quality, personal preferences, provider conduct, bank/payment delays, or events beyond reasonable control. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
You agree to indemnify BookMySpa, its operator, affiliates, officers, employees, and service providers against claims, losses, liabilities, costs, and expenses arising from your misuse of the platform, breach of these Terms, false information, illegal conduct, or infringement of third-party rights.
Governing Law And Disputes
These Terms are governed by the laws of India. Subject to mandatory consumer rights and applicable law, disputes will be handled by courts, tribunals, or other forums that have lawful jurisdiction in India.
